**TERMS AND CONDITIONS**
This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Consumer purchases via the Internet are primarily regulated by the Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E‑Commerce Act, which grant consumers non‑waivable rights. These laws are available (in Norwegian) at lovdata.no. The terms in this agreement are not intended to limit legal rights but outline the key rights and obligations of the parties. ### 1. The Agreement
The agreement consists of these terms and conditions, information provided during checkout, and any specially agreed terms. In case of conflict, specially agreed terms prevail—unless they conflict with mandatory law ([forbrukertilsynet.no][1]). Statutory provisions governing consumer goods purchases also apply.
### 2. The Parties

**Buyer:** The consumer placing the order.
### 3. Price
The stated price is the total amount the buyer must pay, including all taxes and additional costs. No undisclosed charges shall be imposed ([forbrukertilsynet.no][1]).
### 4. Contract Formation
The contract is binding once the buyer submits the order. However, it is not binding if a typographical error occurs and the other party knew or should have known about it ([forbrukertilsynet.no][1]).
### 5. Payment
Payment may be charged when the goods are dispatched. When paying by credit or debit card, the amount may be reserved at order and charged on the day of dispatch. For invoice payments, the invoice is issued at dispatch with a minimum 14‑day payment period. Purchasers under 18 may not use post-delivery invoicing ([forbrukertilsynet.no][1]).
### 6. Delivery
Delivery occurs once the buyer or their representative has taken possession of the item. If no delivery time is stated, delivery must occur without undue delay and no later than 30 days after order placement ([forbrukertilsynet.no][1]).
### 7. Risk of Loss
Risk transfers to the buyer when they or their representative take possession in accordance with section 6 ([forbrukertilsynet.no][1]).
### 8. Right of Withdrawal
Unless exempt, the buyer may cancel the purchase under the Right of Withdrawal Act. Notification must be given within 14 calendar days from when the withdrawal period starts, extended to the next business day if it ends on a weekend or public holiday. To exercise the right, notice must be in writing (form, email, or letter) ([forbrukertilsynet.no][1]).
* **Withdrawal starts** the day after receipt of goods (for single or multiple deliveries, from last delivery; subscriptions from first shipment) ([forbrukertilsynet.no][1]).
* Extended to 12 months if pre-contractual information or withdrawal form was missing. When provided later, the period becomes 14 days from receipt of that information.
Upon withdrawal, the buyer must return the goods within 14 days and bear only the direct cost of returning them, unless otherwise agreed. The buyer may test the goods as would be customary in a physical store without losing withdrawal rights, but may be liable for reduced value if misuse occurs ([forbrukertilsynet.no][1]).
A refund must be issued without undue delay and no later than 14 days from receipt of withdrawal notice—though the seller may withhold refund until receipt of goods or proof they’ve been sent back ([forbrukertilsynet.no][1]).
### 9. Delay or Non-Delivery
If delivery is late or fails, and this is not the buyer’s fault, the buyer may:
* Withhold payment
* Demand performance
* Cancel the contract
* Claim compensation
The buyer should set a reasonable additional deadline before canceling unless the seller refuses delivery or timely delivery was essential ([forbrukertilsynet.no][1]).
### 10. Defective Goods
If goods are defective, the buyer must notify the seller within a reasonable time—at most two months after discovery, and no more than two years after delivery (five years for goods with longer expected lifetimes). Remedies include repair, replacement, price reduction, cancellation, or compensation .
Repair or replacement must occur within a reasonable time; the seller may limit attempts to two. Price reduction must reflect the defect’s severity .
### 11. Seller’s Rights in Case of Buyer Breach
If the buyer breaches the contract (e.g. fails to pay), the seller may:
* Withhold goods
* Demand performance
* Cancel the contract
* Claim compensation
Interest on late payment and collection fees may also apply. If goods are uncollected and unpaid, the seller may charge the actual cost of holding them—except for buyers under 18 ([forbrukertilsynet.no][1]).
### 12. Warranty
Any warranty provided is in addition to statutory rights and does not limit the buyer’s rights under other sections ([forbrukertilsynet.no][1]).
### 13. Personal Data
The seller is responsible for processing personal data. Data collected may only be used to fulfill the contract or as required by law, unless the buyer consents otherwise ([forbrukertilsynet.no][1]).
### 14. Dispute Resolution
Claims should be directed in writing within a reasonable time (see sections 9 & 10). Parties should attempt amicable resolution; unresolved disputes may be escalated to the Consumer Council of Norway (“Forbrukerrådet”) at +47 23 400 500 or forbrukerradet.no. EU consumers may also use the European ODR portal ([forbrukertilsynet.no][1]).
